Contenido completo: «Las evidencias digitales derivadas de la intervención de los servidores de la empresa OVH SAS (situada en Roubaix, Francia, la cual albergaba a los usuarios de Sky-ECC) y que se han incorporado a este procedimiento a través de la Orden Europea de Investigación (OEI) enviada por el Juzgado de Instrucción, consisten en un conjunto de pruebas digitales que resultan de, al menos, dos procesos de filtrado y selección llevados a cabo por las autoridades policiales; carecen de elementos intrínsecos que aseguren su autenticidad e integridad, y, como circunstancia determinante, se han establecido como la única prueba de cargo que podría demostrar la implicación de todos y cada uno de los procesados».

Con este contundente argumento, la Audiencia Provincial de Valencia justificó en enero la absolución de 14 presuntos narcotraficantes, todos ellos imputados por introducir un mínimo de 1.600 kilos de cocaína en contenedores a través del puerto. De esta forma, anuló las pruebas obtenidas tras la desencriptación de la célebre plataforma utilizada por los narcotraficantes para sus comunicaciones.

No obstante, transcurridos seis meses desde dicha decisión y tras la resolución del Tribunal Superior de Justicia de la Comunidad Valenciana, el mismo tribunal ha emitido una opinión diametralmente opuesta. Tras recibir la instrucción de volver a redactar el dictamen, la sentencia resulta ser completamente contraria, imponiendo una pena de 16 años de prisión para Fernando M.S., presunto cabecilla de la organización, y de 13 años para Onofre G.R., considerado uno de sus principales colaboradores.

El nuevo veredicto establece penas que suman un total de 147 años de prisión para todos los imputados. Además de las ya mencionadas de 16 y 13 años y medio para los líderes de la organización, se imponen penas que oscilan entre diez años y medio y siete años para cada uno de los restantes procesados, un total de doce, entre los que se encuentran los dos presuntos cabecillas del gran cártel del Puerto de Valencia que fue desmantelado por la Policía Nacional en 2025, Iván T. R. y Borja M. R., ambos vinculados a la estiba portuaria.

En lo que respecta al modus operandi, este era esencialmente el mismo que el que se observó en el entramado posterior descubierto por las autoridades. Los narcotraficantes contaban con acceso total al puerto gracias a la colaboración de trabajadores corruptos y, posiblemente, también mediante el apoyo de las fuerzas de seguridad -como se recordará, el jefe de la Guardia Civil fue detenido por ello en otro proceso- y de esta manera ‘rescataban’ los contenedores previamente marcados que llegaban a España utilizando el método del gancho ciego. Se les atribuye en este caso la recogida de alrededor de 1.650 kilos de droga.

En cuanto a la evolución judicial futura del caso, no cabe duda de que llegará al Tribunal Supremo, que será el encargado de determinar no solo el destino de esta investigación, sino de muchas otras que utilicen como elementos fundamentales la prueba de la desencriptación de Sky, EncroChat o Anom. En su momento, el Tribunal Supremo dictaminó que estas pruebas eran válidas siempre que existiesen otros datos que corroboraran lo que de ellas se deducía, aunque mostró dudas acerca de su legitimidad como prueba principal. Las defensas de los actualmente condenados sostendrán esa postura y continuarán cuestionando la cadena de custodia de las mismas.

Full Content: "The digital evidence derived from the intervention of the servers of the company OVH SAS (located in Roubaix, France, which hosted the users of Sky-ECC) and that has been incorporated into this procedure through the European Investigation Order (EIO) sent by the Investigating Court, consists of a set of digital proofs resulting from at least two filtering and selection processes carried out by the police authorities; they lack intrinsic elements that ensure their authenticity and integrity, and, as a determining circumstance, they have been established as the only incriminating evidence that could demonstrate the involvement of each and every one of the defendants."

With this forceful argument, the Provincial Court of Valencia justified in January the acquittal of 14 alleged drug traffickers, all charged with introducing a minimum of 1,600 kilos of cocaine in containers through the port. In this way, it annulled the evidence obtained after the decryption of the famous platform used by drug traffickers for their communications.

However, six months after that decision and following the ruling of the High Court of Justice of the Valencian Community, the same court has issued a diametrically opposed opinion. After receiving the instruction to rewrite the ruling, the sentence turns out to be completely contrary, imposing a sentence of 16 years in prison for Fernando M.S., the alleged leader of the organization, and 13 years for Onofre G.R., considered one of his main collaborators.

The new verdict establishes sentences that total 147 years in prison for all the defendants. In addition to the aforementioned 16 and 13 and a half years for the leaders of the organization, sentences ranging from ten and a half years to seven years are imposed on each of the remaining twelve defendants, among whom are the two alleged leaders of the large cartel of the Port of Valencia that was dismantled by the National Police in 2025, Iván T. R. and Borja M. R., both linked to port stevedoring.

Regarding the modus operandi, it was essentially the same as that observed in the subsequent network uncovered by the authorities. The drug traffickers had total access to the port thanks to the collaboration of corrupt workers and, possibly, also through the support of security forces - as will be remembered, the head of the Civil Guard was arrested for this in another case - and in this way they 'rescued' the previously marked containers that arrived in Spain using the blind hook method. They are attributed in this case with the collection of around 1,650 kilos of drugs.

As for the future judicial evolution of the case, there is no doubt that it will reach the Supreme Court, which will be responsible for determining not only the outcome of this investigation but also many others that use the decryption evidence of Sky, EncroChat, or Anom as fundamental elements. At the time, the Supreme Court ruled that this evidence was valid as long as there were other data corroborating what could be deduced from it, although it expressed doubts about its legitimacy as primary evidence. The defenses of those currently convicted will maintain that position and continue to question the chain of custody of the evidence.
