La reciente legalización del uso recreativo de la marihuana en Tailandia, siguiendo un modelo similar al de Canadá y ciertas regiones de Estados Unidos, ha generado, como es bien sabido, un notable aumento en la producción de sustancias estupefacientes. Ante esta situación, el gobierno tailandés ha decidido revertir su postura, permitiendo que los narcotraficantes dispongan de un considerable stock que están sacando al mercado en grandes volúmenes. Una de las rutas más utilizadas por estos grupos criminales, tanto por vía marítima como aérea, tiene como destino la ciudad de Barcelona.

Con el objetivo de combatir este fenómeno, agentes de Vigilancia Aduanera de la Agencia Tributaria, junto con el personal de la Dirección Nacional de Inteligencia e Investigación Aduanera de Francia (DNRED), han desmantelado una organización dedicada a la extracción de marihuana en el puerto de Barcelona. Esta operación, que ha recibido el nombre de Waterfall, ha culminado con la detención de cinco individuos pertenecientes a la red delictiva –entre ellos, los receptores de la droga y un representante aduanero– así como con la intervención en territorio francés de un contenedor que transportaba 1.700 kilos de marihuana procedente de Tailandia. Este contenedor fue objeto de una entrega controlada judicializada que se realizó hasta su llegada al puerto de Barcelona, y su posterior entrega en las instalaciones del importador facilitó la neutralización de la red.

El contenedor en cuestión había salido de Tailandia, realizando escalas en Malasia y Singapur antes de llegar a Francia. La estrategia utilizada por la organización delictiva para llevar a cabo el contrabando consistía en aprovechar la denominación de empresas reconocidas en el tráfico de contenedores, con el fin de disfrazar un envío del que carecían de documentación oficial, buscando así eludir eventuales controles por parte de las autoridades aduaneras.

Luego de establecer coordinación con la Subdirección General de Operaciones del Servicio de Vigilancia Aduanera de la Agencia Tributaria, la Dirección Nacional de Inteligencia e Investigaciones Aduaneras de Francia solicitó a la fiscalía de Aix-en-Provence la autorización necesaria para implementar una entrega vigilada internacional, con el propósito de identificar y arrestar a los destinatarios de la droga. Esta solicitud fue respaldada por la Fiscalía Antidroga y la autoridad judicial en España.

Posteriormente, la jurisdicción interregional especializada de Marsella remitió el caso a la DNRED para su investigación correspondiente. Al llegar a Barcelona, el 22 de mayo, el contenedor fue objeto de vigilancia continua por parte de funcionarios de Vigilancia Aduanera mientras se procedía a la descarga de la mercancía en el almacén de destino, dentro de las instalaciones portuarias. Las observaciones se extendieron hasta que el 24 de mayo, los investigadores detectaron a un grupo de cuatro personas, dos de nacionalidad española y dos de nacionalidad china, quienes accedieron al almacén en horario de cierre y comenzaron a manipular la mercancía bajo supervisión.

En ese preciso instante, los cuatro sujetos fueron detenidos. Posteriormente, también se arrestó al representante aduanero responsable del envío por su implicación en la organización delictiva. En total, se lograron incautar 1.456 sacos termosellados que contenían marihuana, en contenedores que sumaban un total de 5.000 kilos de mercancía.

La investigación de esta operación sigue en curso y no se descartan eventuales detenciones adicionales relacionadas con la infraestructura logística o financiera del grupo criminal, bajo la supervisión del Juzgado de Instrucción número 11 de Barcelona.

**Title: Important Marijuana Trafficking Route Discovered Between Thailand and Barcelona**

The recent legalization of recreational marijuana use in Thailand, following a model similar to that of Canada and certain regions of the United States, has generated, as is well known, a notable increase in the production of narcotic substances. In light of this situation, the Thai government has decided to reverse its stance, allowing drug traffickers to have a considerable stock that they are bringing to market in large volumes. One of the most utilized routes by these criminal groups, both by sea and air, is destined for the city of Barcelona.

With the aim of combating this phenomenon, agents from the Customs Surveillance of the Tax Agency, along with personnel from the National Directorate of Intelligence and Customs Investigation of France (DNRED), have dismantled an organization dedicated to the extraction of marijuana at the port of Barcelona. This operation, named Waterfall, has culminated in the arrest of five individuals belonging to the criminal network – including the drug recipients and a customs representative – as well as the intervention in French territory of a container transporting 1,700 kilos of marijuana from Thailand. This container was subject to a judicially controlled delivery that was carried out until its arrival at the port of Barcelona, and its subsequent delivery at the importer’s facilities facilitated the neutralization of the network.

The container in question had departed from Thailand, making stops in Malaysia and Singapore before arriving in France. The strategy used by the criminal organization to carry out the smuggling consisted of taking advantage of the name of recognized companies in container trafficking, in order to disguise a shipment for which they lacked official documentation, thus seeking to evade potential checks by customs authorities.

After establishing coordination with the General Subdirectorate of Operations of the Customs Surveillance Service of the Tax Agency, the National Directorate of Intelligence and Customs Investigations of France requested the necessary authorization from the Aix-en-Provence prosecutor's office to implement an international monitored delivery, with the purpose of identifying and arresting the recipients of the drug. This request was supported by the Anti-Drug Prosecutor's Office and the judicial authority in Spain.

Subsequently, the specialized interregional jurisdiction of Marseille referred the case to DNRED for its corresponding investigation. Upon arriving in Barcelona on May 22, the container was under continuous surveillance by Customs Surveillance officials while the merchandise was being unloaded at the destination warehouse within the port facilities. The observations continued until May 24, when investigators detected a group of four individuals, two of Spanish nationality and two of Chinese nationality, who accessed the warehouse after hours and began handling the merchandise under supervision.

At that precise moment, the four individuals were arrested. Subsequently, the customs representative responsible for the shipment was also arrested for his involvement in the criminal organization. In total, 1,456 vacuum-sealed bags containing marijuana were seized, in containers amounting to a total of 5,000 kilos of merchandise.

The investigation of this operation is ongoing, and further arrests related to the logistical or financial infrastructure of the criminal group are not ruled out, under the supervision of the Investigating Court number 11 of Barcelona.
