Título: Se absuelve al acusado de haber organizado el mayor alijo de heroína de Europa en 2016

Contenido completo: Sorpresa parcial en la Audiencia de Pontevedra. Un caso en el que ya se habían dictado tres absoluciones en el juicio inicial sobre los eventos, se culminó esta semana con una cuarta exoneración, en la figura del presunto organizador del que fue el mayor alijo de heroína registrado en Europa en el año 2016, los 54 kilos incautados por la Udyco en la ciudad del Lérez en marzo de ese mismo año, ocultos en una elaborada caleta de un Porsche Cayenne. El implicado en esta última fase judicial es Nikolin J., un destacado empresario del sector cerámico, con significativos intereses en la Comunidad Valenciana y en su país natal, Albania, acusado de liderar la banda criminal que llevó a cabo el mencionado transporte de estupefacientes.

La Sección Cuarta considera que no hay pruebas suficientes para incriminarle, y esto ocurre a pesar de que se reunió, en los días previos a la incautación de la droga, con la persona encargada de conducir el mencionado vehículo, Rinush G., así como con quien iba a recibir dicho alijo en el sur de la provincia de Pontevedra, Castor M. Ambos, en contraste, fueron condenados por estos hechos.

El Ministerio Fiscal había solicitado una pena de ocho años de prisión para un individuo que fue arrestado en 2022 por Interpol a demanda de la Audiencia pontevedresa, en un arresto que causó gran revuelo mediático en Tirana, donde se llevó a cabo. Consideraba que eran suficientes las pruebas mencionadas, corroboradas mediante vigilancia y seguimientos realizados por los agentes al acusado en Málaga y en Barcelona, y posteriormente también en Baiona, donde volvió a encontrarse con Castor. Todo esto coincidía temporalmente con el transporte de la droga. El fiscal también presentó mensajes de la Blackberry del sospechoso en los que, tras la caída de la heroína, preguntaba a su socio gallego (Castor) sobre el paradero del conductor del Porsche (Rinush), pero esa prueba tampoco fue considerada suficiente.

La Audiencia, por su parte, aceptó el argumento expuesto por el ciudadano albanés durante el juicio. En primer lugar, comenzó por definir su relación con Castor M. Aclaró que había desarrollado con él una relación de amistad durante años, después de que un amigo en común se lo presentara, y subrayó que el viaje a Galicia que la Policía sostiene que realizó para coordinar el transporte de la droga, en realidad fue para asistir a las bodas de plata de su amigo de Mos junto a su familia. Respecto a los encuentros en Barcelona y otro en Málaga, en los que la Policía sostiene que se discutieron temas relacionados con las drogas, Janina afirmó que esos viajes estaban vinculados a su trabajo en empresas de compraventa de materiales de construcción y, en el caso de Barcelona, en compañía de arquitectos de su país en un viaje organizado con el apoyo de Porcelanosa, empresa con la que trabajaba en aquel momento y cuyos intereses en Albania sigue representando su familia en la actualidad.

Precisamente en Barcelona, se encontró también con Rinush, el hombre que partiría poco después hacia Países Bajos en busca del alijo. Sobre este asunto, aclaró que su amigo Castor lo había presentado, ya que este había llegado a la Ciudad Condal para saludarle y pensó en presentárselo por el hecho de ser albanés residente en Cataluña.

Uno de los elementos probatorios más sólidos que poseía el fiscal fueron los mensajes obtenidos de la Blackberry del investigado, en los cuales se refería de manera clara a la mencionada operación de narcotráfico. En estos mensajes, según afirmaron los miembros de la Udyco, el empresario albanés que ha sido absuelto informaba a Castor sobre la salida de Rinush en busca de la droga. Sin embargo, el tribunal dio crédito a la declaración del acusado, quien afirmó que no había escrito esos mensajes, considerando que no estaba suficientemente acreditado que el ‘nickname’ proporcionado por la Policía correspondiera al acusado.

Nikolin, durante el juicio, afirmó textualmente que «Yo nunca me he dedicado al tema de las drogas, y nunca en mi presencia se ha hablado del tema de drogas. En eso tengo que ser muy claro».

Full content: Partial surprise in the Pontevedra Court. A case in which three acquittals had already been issued in the initial trial regarding the events culminated this week with a fourth exoneration, concerning the alleged organizer of what was the largest heroin shipment recorded in Europe in 2016, the 54 kilos seized by the Udyco in the city of Lérez in March of that same year, hidden in an elaborate compartment of a Porsche Cayenne. The individual involved in this latest judicial phase is Nikolin J., a prominent businessman in the ceramics sector, with significant interests in the Valencian Community and in his home country, Albania, accused of leading the criminal gang that carried out the aforementioned drug transport.

The Fourth Section considers that there is not enough evidence to incriminate him, and this occurs despite the fact that he met, in the days leading up to the drug seizure, with the person responsible for driving the mentioned vehicle, Rinush G., as well as with the individual who was to receive the shipment in the south of the province of Pontevedra, Castor M. Both, in contrast, were convicted for these events.

The Public Prosecutor's Office had requested a sentence of eight years in prison for an individual who was arrested in 2022 by Interpol at the request of the Pontevedra Court, in an arrest that caused a great media stir in Tirana, where it took place. They considered that the aforementioned evidence, corroborated through surveillance and follow-ups conducted by agents on the accused in Málaga and Barcelona, and later also in Baiona, where he met again with Castor, was sufficient. All of this temporally coincided with the transport of the drug. The prosecutor also presented messages from the suspect's Blackberry in which, after the heroin shipment fell through, he asked his Galician partner (Castor) about the whereabouts of the Porsche driver (Rinush), but that evidence was also not deemed sufficient.

The Court, for its part, accepted the argument presented by the Albanian citizen during the trial. First, he began by defining his relationship with Castor M. He clarified that he had developed a friendship with him over the years, after being introduced by a mutual friend, and emphasized that the trip to Galicia that the Police claim he made to coordinate the drug transport was actually to attend his friend's silver wedding anniversary along with his family. Regarding the meetings in Barcelona and another in Málaga, in which the Police claim drug-related topics were discussed, Janina stated that those trips were linked to his work in companies dealing with the buying and selling of construction materials and, in the case of Barcelona, in the company of architects from his country on a trip organized with the support of Porcelanosa, a company he was working with at that time and whose interests in Albania are still represented by his family today.

Precisely in Barcelona, he also met with Rinush, the man who would shortly depart for the Netherlands in search of the shipment. Regarding this matter, he clarified that his friend Castor had introduced him, as he had arrived in the Catalan city to greet him and thought to introduce him because he was Albanian residing in Catalonia.

One of the strongest pieces of evidence the prosecutor had were the messages obtained from the Blackberry of the investigated individual, in which he clearly referred to the aforementioned drug trafficking operation. In these messages, according to Udyco members, the acquitted Albanian businessman informed Castor about Rinush's departure in search of the drugs. However, the court credited the accused's statement, who claimed he had not written those messages, considering that it was not sufficiently established that the 'nickname' provided by the Police corresponded to the accused.

Nikolin, during the trial, stated verbatim that "I have never been involved in drugs, and never in my presence has the topic of drugs been discussed. I have to be very clear about that."
